Maradona death trial falls through after clandestine documentary controversy

Judges Maximiliano Savarino and Verónica Di Tommaso considered that judge Julieta Makintach’s intervention had been ‘in detriment of all parts, and marking the nullity of the debate’

The case over the death of Argentine football star Diego Maradona will go to a retrial after the current process was annulled on Thursday’s hearing. The decision comes after judge Julieta Makintach resigned from the court on Tuesday amid controversy over her involvement in a secret documentary about the trial.

The decision was taken by the two remaining members of the San Isidro 3rd Criminal Court, Maximiliano Savarino and Verónica Di Tommaso. The former said at the announcement that Makintach had taken part in “multiple discussions with witnesses and lawyers” during breaks in the daily proceedings, “in detriment of all parts, and marking the nullity of the debate.”

Both judges sought to distance themselves from Makintach, who was given a 90 day suspension from duties by the Buenos Aires Province Supreme Court.

“For us, this was a worthy trial,” said Di Tommaso after the announcement. “Regrettably, the person who is missing today, had different intentions.”

She went on to pay homage to Maradona, referencing the former star’s retirement game speech.

“Someone made a mistake and is paying for it, as she’ll have to keep giving explanations for her actions, but she’s not the Judiciary, and justice won’t be stained,” Di Tommaso said.

The case will now be sent to a different court for a retrial, selected via random draw. This means all witnesses will have to give testimony and all proof presented again. There is no date yet for when this will happen.

Makintach resigned from the trial on Tuesday after accepting the prosecutor’s request for recusal. Prosecutor Patricio Ferrari presented evidence to back his request, including several clips from a clandestine, unauthorized documentary on the proceedings recorded inside the courtroom. 

According to Ferrari, the documentary — which had been titled Justicia Divina (Divine Justice) aimed to reconstruct Maradona’s life and death, as well as recounting the judge’s life.
